    # Short-Term Rental Agreement, Tenant Undertaking & Terms of Service

    This Short-Term Rental Agreement, Tenant Undertaking & Terms of Service (the “Agreement”) is entered into between the Tenant (“Tenant”) and J Town Rentals LLC (“JTown Rentals”), acting as property manager and/or  rental agent of the Property.

    By booking, occupying, or using the property, the Tenant confirms that he/she has read, understood, and agreed to all terms and conditions set forth herein.

    1. Purpose of Agreement

    Whereas, the Tenant wishes to rent an apartment for a short-term stay in Jerusalem, Israel;

    And whereas, JTown Rentals LLC has located a suitable rental property based on the Tenant’s stated requirements and preferences;

    And whereas, the Tenant has reviewed photographs and/or inspected the property and agrees to rent the apartment subject to the terms of this Agreement;

    Therefore, the parties agree as follows.

    2. Entire Agreement

    This Agreement constitutes the complete understanding between the parties relating to the rental of the property.

    Any amendments, modifications, or additions to this Agreement shall only be valid if made in writing and approved by both the Tenant and the Property Owner or its authorized representative.

    3. Booking and Reservations

    All bookings are subject to availability and final confirmation.

    A deposit equal to 33% of the booking total is required at the time of booking. The remaining balance is due no later than 14 days prior to check-in unless otherwise agreed in writing. For Holiday bookings, the balance is due 30 days prior to arrival.

    JTown Rentals reserves the right to refuse or cancel reservations that violate these terms.

    4. Property Substitution

    The Tenant agrees to lease the apartment listed in the booking confirmation.

    In the event of unforeseen maintenance issues, property damage, double bookings, force majeure, or other circumstances beyond JTown Rentals’ reasonable control, JTown Rentals may substitute the reserved apartment with a comparable property of similar standard and location.

    The Tenant will be notified of any such change as soon as reasonably possible.

    5. Cancellation and Non-Refundability

    Cancellation policies vary depending on the property and booking type.

    Unless otherwise stated in the applicable cancellation policy, rental payments are non-refundable.

    The Tenant acknowledges that payment obligations remain valid and enforceable regardless of whether the Tenant occupies or makes use of the property during the rental period.

    6. Check-In and Check-Out

    Standard check-in time is from 4:00 PM.

    Standard check-out time is no later than 11:00 AM.

    Early check-in or late check-out may be requested but cannot be guaranteed unless confirmed in writing.

    Check-ins may not be available on Shabbat or Jewish holidays. Guests should coordinate in advance if arrival falls during such times.

    7. Status of Tenancy

    The Tenant acknowledges and agrees that:

    • He/she is not a “protected tenant” under Israeli law;
    • No “key money” has been paid;
    • Israeli tenancy protection laws do not apply to this Agreement;
    • This Agreement constitutes a temporary short-term accommodation arrangement only.

    8. Extensions of Stay

    The Tenant may request an extension of the rental term.

    Approval of any extension shall be entirely at the discretion of JTown Rentals and may be denied for any reason.

    9. Failure to Vacate

    Failure to vacate the apartment by the agreed check-out time and date may result in penalties equal to 200% of the applicable daily rental rate for each unauthorized additional day of occupancy.

    The Tenant shall also remain responsible for any damages or losses incurred due to delayed departure.

    10. Use of Property

    The apartment is provided solely for the Tenant’s personal residential use.

    The Tenant may not:

    • Sublet or assign the apartment;
    • Transfer occupancy rights to third parties;
    • Use the apartment for commercial activities, events, or parties;
    • Exceed the maximum permitted occupancy.

    Written approval from JTown Rentals is required for any exceptions.

    11. Tenant Responsibilities

    The Tenant agrees to:

    • Maintain the apartment in a clean and reasonable condition;
    • Treat the property, furnishings, and appliances with care;
    • Respect neighbors and avoid excessive noise or disturbances;
    • Wash used dishes and cookware before departure;
    • Remove garbage from the apartment;
    • Leave the apartment broom-swept;
    • Turn off lights, air conditioning, and the hot water boiler when not in use or upon departure.

    12. Damages and Missing Items

    The Tenant shall be fully responsible for any damage, loss, excessive dirtiness, missing items, or misuse caused by the Tenant or guests during the stay.

    The Property Owner and/or JTown Rentals may charge the Tenant for repair, replacement, cleaning, or restoration costs where applicable.

    13. Electricity Usage

    The rental price includes electricity usage of up to 75 kilowatts per day.

    Usage exceeding this allowance shall be charged at a rate of 0.65 NIS per additional kilowatt.

    The Tenant agrees to use electricity responsibly and conserve energy where possible.

    14. Repairs and Maintenance

    Should repairs or maintenance be required during the stay, the Tenant shall notify JTown Rentals promptly.

    JTown Rentals will make commercially reasonable efforts to address reported issues within 24 business hours.

    Temporary interruptions to utilities or building systems due to repairs, maintenance, municipal works, or circumstances beyond reasonable control shall not constitute grounds for refunds or cancellation.

    15. Smoking Policy

    Smoking is strictly prohibited inside the apartment unless explicitly stated otherwise in writing.

    Violation of this policy may result in additional cleaning or damage charges.

    16. Lost or Abandoned Property

    Any personal belongings left behind after check-out shall be considered abandoned (“hefker”).

    JTown Rentals and the Property Owner shall not be responsible for storing, returning, shipping, or replacing abandoned items.

    17. Property Viewings During Stay

    The Tenant acknowledges that prospective future tenants, purchasers, contractors, or maintenance personnel may require access to the apartment during the stay.

    Reasonable advance notice will be provided whenever possible, and visits will be conducted with minimal disruption.

    18. Liability Disclaimer

    JTown Rentals LLC acts solely as the representative and management company for the Property Owner.

    JTown Rentals and the Property Owner shall not be liable for any loss, theft, injury, accident, delay, inconvenience, personal injury, illness, or damage suffered by the Tenant or guests during the stay, except where caused directly by gross negligence or willful misconduct.

    The Tenant assumes full responsibility for personal belongings and valuables.

    19. Credit Card Authorization

    The Tenant acknowledges and agrees that the credit card used for booking may be securely stored by the payment processor and charged for:

    • Remaining booking balances;
    • Damages or missing items;
    • Excessive cleaning;
    • Electricity overages;
    • Late check-out penalties;
    • Violations of this Agreement;
    • Any unpaid fees or charges associated with the reservation.

    By accepting this Agreement, the Tenant expressly authorizes JTown Rentals LLC to process such charges where applicable.

    20. VAT (Value Added Tax)

    Israeli citizens and individuals obligated under Israeli tax law are subject to 17% VAT.

    Foreign tourists may qualify for VAT exemption upon presentation of a valid B2 entry permit or border control entry card in accordance with Israeli regulations.

    VAT is not included in displayed pricing unless specifically stated otherwise.

    21. Kashrus Policy

    If a property is designated as “Kosher” or “Kosher Mehadrin,” the Tenant confirms that he/she will maintain the stated kosher standard during the stay.

    JTown Rentals reserves the right to cancel a booking if it reasonably determines that the Tenant does not intend to comply with the kosher standards of the property.

    Violation of this policy may result in penalties of up to $1,000.

    22. Pricing Errors and Property Availability

    While every effort is made to ensure accurate pricing and availability, errors may occasionally occur.

    JTown Rentals LLC reserves the right to cancel a reservation within 24 hours of booking confirmation in the event of:

    • Pricing errors;
    • Calendar synchronization errors;
    • Property unavailability;
    • Listing inaccuracies;
    • Force majeure or operational issues.

    In such situations, JTown Rentals will make reasonable efforts to provide an alternative accommodation.

    23. Modifications to Terms

    JTown Rentals reserves the right to modify or update these terms at any time.

    Updated terms shall become effective upon posting to the website or distribution to guests.

    Continued use of the property or services constitutes acceptance of the revised terms.

    24. Governing Law

    This Agreement shall be governed by and interpreted in accordance with the laws of the Rabbinical courts in the State of Israel.

    Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the competent Rabbinical courts in Jerusalem, Israel.
