TENANT’S  UNDERTAKING AND OBLIGATIONS

 Whereas the tenant is interested and desirous in renting an apartment for a short- term period in Jerusalem, Israel;

And whereas JTown Rentals LLC, a property and real estate company, has succeeded in finding a suitable rental which meets with and serves the tenant’s express requirements and needs;

And whereas the tenant has seen photographs of it or inspected the apartment, and wishes to rent the property in terms of this undertaking.

Therefore, it is hereby expressly agreed, declared and promised by the tenant as follows:

  1. The above preamble constitutes an integral part of this undertaking.
  2. The use of the masculine form in the drafting of this undertaking is for convenience purposes only and does not in any way derogate from the tenant’s obligations, undertakings and commitments, should the tenant be a female.
  3. All changes to this undertaking, after it being signed, shall be in writing and signed by both the tenant and JTown Rentals LLC. 
    1.  The tenant agrees to pay the owner of the apartment the full amount as stated in the booking details in addition to the stated cleaning fee. In the event the tenant has not paid in full 3 weeks prior to arrival, JTown Rentals LLC may charge his card for the remaining balance. 
    2. The tenant is aware that under no circumstances shall the amount owing to the owner of the property and to be paid by him for the rental be returned and that his obligation to pay the aforesaid rent will apply and be valid and legally enforceable whether the tenant makes use of the property or not, and/or whether the tenant is present in the apartment during the rental period or not. In the event the tenant wishes to cancel the rental, if prior to the 3 week deadline, he will just lose the deposit. Afterwards, he may lose full payment. Where possible, JTown Rentals LLC will do their utmost to find a replacement tenant and then issue a credit or refund according the the circumstances. 
      1. The tenant agrees to enter the premises no earlier than 4:00 PM and to vacate the apartment by 11:00 AM on the agreed above date and is aware that he is not a “protected tenant” in terms of Israeli law, that he has not paid any “key money” in order to acquire rights as a protected tenant under Israeli law and that the laws governing tenancy protection do not apply to the tenant or to this undertaking.
    3. The tenant is entitled to request that the rental period be extended but is aware that the owner of the apartment is under no legal obligation to agree to any such request.
    4.  Failure by the tenant to vacate the apartment at the end of the rental term will be subject to a penalty of double the daily rental rate per day.  
    5. The tenant will replace or compensate the owner of the property for any missing or damaged items belonging to the apartment and be responsible to pay for any willful or negligent damage caused by him or by his guests to the apartment.
    6.  The tenant will be responsible for keeping the premises and the contents of the apartment clean and in good repair, and undertakes not to cause any disturbance to the neighbors. The tenant will leave the apartment broom swept clean, lights, AC and hot water boiler turned off. 
    7. The tenant agrees to use the apartment for his personal use and residence only and undertakes not to transfer his rights in it to any other party without the property owner’s express advance permission.
    8. The tenant is aware that JTown Rentals LLC is not the owner of the property and serves entirely as the property owner’ representative. Consequently, any legal complaint the tenant may have connected to the renting of the property will be determined by and dealt with exclusively by the property owner and not by JTown Rentals LLC.
    9. The tenant is aware that during the course of his stay in the apartment other prospective tenants may come by to inspect the apartment. The tenant shall receive adequate advance warning of any such visit – which will be carried out with minimum inconvenience to the tenant.  
    10.  The amount paid by the tenant covers the costs of electricity use up to 1000 kilowatts. Should a reading of the electricity meter indicate that the tenant has exceeded the aforementioned electricity usage, then the tenant will be liable in the amount of 60 agorot for every kilowatt exceeding the above-mentioned quota. In light of the terms of this paragraph the tenant agrees to use electricity sparingly and to switch off the lights and air-conditioning unit when he is out of the apartment.
    11. Should any repairs be needed, the tenant will alert the property manager and within 24 business hours, the repairs will be attended to and resolved.
    12. The tenant will provide credit card information which will be used both to hold the rental as well as security for clauses 6, 9, 10 and 15. It is to JTown Rentals LLC’s full discretion as to how much to charge. By signing this agreement, the tenant authorizes these charges.
    13. The tenant and his guests will not smoke in the apartment.
    14. If anything is left in the apartment, it will be considered hefker. We will not be responsible to return or replace it.
    15. If the unit you are renting is marked as Kosher Mehadrin or Shomer Shabbat neighborhood, be sure this is suitable for you. Otherwise, JTown Rentals has a right to cancel the agreement prior or even during your stay. 
  • If JTown Rentals LLC is unable to proceed with your booking for any reason, you will receive an email stating as such within 24 business hours as well  a full refund. 
  • The tenant may only host for sleeping  the amount of people stated in the reservation. If this is violated. There will be a fee of $100 per person per day. 
  • The tenant may not host more than 7 additional people at any time, for meals or any other reason without written permission from JTown Rentals LLC. A violation of this allows a penalty of up to $1000.
